New Jersey Chapter 6 of Title 18A Verifications

As more states begin to pass legislation over not “passing the trash”, human resources and applicants alike are facing more paperwork and duties for the onboarding process. The good news is that we are here to help. Human resources in New Jersey are utilizing our services to outsource their educational employment requirements.

What is the legislation?

You can read the law in its entirety here, but the law was passed to help reduce the number of predators and abusers continue their careers with children. Schools sometimes opt to handle indiscretions privately without including law enforcement. Without law enforcement becoming involved, the applicant is free to apply to a new school, this helps schools from hiring someone with a checkered past.

How does it work?

  • The institution must complete our standard new client paperwork. We are PBSA-accredited, and therefore we need proof on file for permissible purpose for requested reports.
  • Once a company is signed up to use our service, they will provide us with the applicant’s consent form, their resume or other form outlining their past employment, and the Sexual Misconduct / Abuse Disclosure Release, signed by the applicant.
  • We will begin sending the requests to the past and current employers. We meticulously document all our attempts.
  • We reach out to all the past employers within 20 years.
  • We compile a completed report containing all of the verifications. If an employer was not responsive, we will note this, with all the attempts made to receive it.

How Long Does It Take?

We strive to complete these verifications as soon as possible. We do this by confirming our requests have been received. Then do our due diligence to follow up with the status of the requests. But we are at the liberty of the past (or current employer) and have no way of providing an accurate estimate of turn-around time for this reason. Our reports range between the same day (for the best case) and four weeks (for the worst. The average report is typically completed within a week.
